Towards a Framework for Legal and Judicial Capacity Building in Developing Economies: A marketing Viewpoint

One of the most crucial elements for developing economies in today's global environment is the existence of a viable legal system. It is an effectively operating legal system, which ultimately frames the environment in which many of the required activities surrounding commercial transactions reside. The lack of an operational system can be a major impediment to Foreign Direct Investment, and even simple importing and exporting transactions in developing economies. In this working paper the authors share initial findings from a field study in Bangladesh intended to assess the judicial system and its effects on socio-economic development. The essence of the preliminary findings is captured in Figure 1, which indicates forces and factors to consider, should policy makers effect changes to improve the judicial system. The overarching conclusion is that the importance of an effective, just and efficient judicial system is under-appreciated, yet imperative to optimal socio-economic development and societal welfare and thus this system must be a target for reform.
