Police and investigating judge: Defining roles in pre-trail evidence collecting

The purpose of this paper is to explore the relation between police and investigating judge in the process of gathering evidence during pre-trial proceedings and to identify difficulties in the existing legislative model. The present model that was basically introduced four decades ago, entrusted main powers of collecting evidence to the investigating judge. It was planned that police authorities could substitute investigating judge only in cases of urgency. Furthermore, regular police inquires were considered as gathering of informal information aiming to help the judge to collect evidence.
